Legal Question in Family Law in South Carolina
Child DNA
Child father started pay child support about 8 mo. ago but until then he didn't come around are help support him. I took him to court after he had a domestic violence charge. I am not sure if he is the father. He has been paying support for about 8 mo. now but I would like to do a DNA test to be sure he is the father. I was advice not to do this. Is this correct advice? If not how do I go about having it done and how much does it cost?

Re: Child DNA
Florida Law - You can file a Paternity Action to determine whether he is the father or not. A DNA test would be required and if he is not found to be the father would not have to pay any more child support and you may have to pay back the child support he paid. Call your local county courthouse to find out how much this action costs to file and I also suggest that you retain an attorney if you decide to go ahead with the case since this could get complicated. Good Luck.
