Legal Question in Family Law in South Carolina

Child Support

My support is court ordered during divorce and payments are made directly to me. My ex is behind. What is the first step I should take in getting the past due dollars? Do I need an attorney because I am limited on funds.

Re: Child Support

Typically, the best course of action is to file a Rule to Show Cause (contempt action) to have the Court address your ex's failure to pay the required child support payments. You can file such an action yourself, but you will typically fare much better if you have an attorney assist you with this process. In many cases, the Court will require the person held in contempt to reimburse you for your attorney's fees and costs as well.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case. If you need more information, you can visit my family law blog (www.SCFamilyLaw.com) or our website (www.StevensFirm.com). I wish you the best of luck.
