Legal Question in Family Law in South Carolina

child support and daycare reduction

how do i go about taking a person back to court for a decrease in child support which is being deducted from my pay to pay for daycare that my children dont need because their mother doesnt work she stays at home. she got a job long enough to take me back to court to have daycare taken out of my check so i couldnt stop paying it when she quit her job.. this was the first job she has had in about 7 or 8 years .. she never wanted to work when we were together. she has I believe quit this job now. and im still paying daycare while she sits at home and my 4 year old is taken care of by other people that I have to pay.. I cannot afford this because without the daycar i already have to pay 168.00 a week in child support and I have to still make her house payment every month for two more years.. Now that they are taking daycare out of my pay too I have 250.00 a week coming out of my check and I cannot afford to live. I want to take her back to court to drop the childcare that is coming out of my check.. how do i go about this.. i cannot afford a lawyer and apparently dont need one to do that because she didnt need one to take me to court to get the daycare taken out of my check. any help you can give me will be appreciated

Re: child support and daycare reduction

If the circumstances have changed since the child support was calculated, then you can certainly seek a recalculation. The only child care expenses that are supposed to be included are "work related" ones.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
