Legal Question in Family Law in South Carolina

Child Support Issues

My ex was paying child support, and then he all of a sudden quit,

and he is supposed to be drawing unemployment in the amount of $303/week starting on May 28th.

He wants to go back to the court to petition them to lower his payments.

the only income that I have is SSI for 2 of my children and I need the support that he pays to make ends meet. What can be done to keep him from getting his payments lowered?

Re: Child Support Issues

Ultimately, it will be up to the Judge as to whether or not to lower his child support payments. However, the Court can take his "earning capacity" into account instead of his income if he is unemployed or voluntarily underemployed.

If you need more information, you can visit my family law blog (www.SCFamilyLaw.com) or our website (www.StevensFirm.com). I wish you the best of luck.
