Legal Question in Family Law in South Carolina

Child Support law for outside business

how does a outside income when in a construction business play into child support calculation?

I have asked for W2's per court order but have not yet been provided them. He has a team of 4 employees that he pays salary for for work that is done. What is concidered necessary supplies and materials. what can be included in calculations for support along with regular pay from main employment. Works the construction part time on weekends and during the week after work. I feel that he is withholding income from me. Per court order any change in circumstances shall be revisited and support recalculated. He has his own accountant for his outside employement.

Re: Child Support law for outside business

When a person owns a business and/or does work in addition to his "primary" job, it is always tricky proving what his actual income is for child support purposes. These situations are very fact specific, and they take an individualized approach to be accurate. In many cases, an accountant can be helpful in reviewing the financial records of a person or business to help compute and compile the necessary information.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
