Legal Question in Family Law in South Carolina
Child Visitation
I have moved from my hometown where I got my divorce and custody settled. I now live 2 hours away and my ex is giving me a hard time about where to pick up the kids. We had a mutual agreeement to meet half way, but now this has become a problem. Family Court has my new residence listed on file as my childrens place of residence. The custody papers stated that the children were to picked up at my parents home (at the time of divorce where we were residing). Is my new residence the legal residence to have them picked up? Again, family court has the current information where child support payments are mailed to? Do I have grounds to have him come here to pick up the kids from our home and not have to meet half way anymore?

Re: Child Visitation
Without looking at your Order and the specific language in it, it is not possible to give you a definite answer. However, the Court generally places more of a burden on the person moving away, so it is probably in your best interest to try to reach an amicable resolution with him.
These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
