Legal Question in Family Law in South Carolina
Childrens name change
My children carry the last name of their biological father whom I was never married to. I am now married and would like to chane their last name to my husbands last name. How do I do this legally?

Re: Childrens name change
You need to contact an attorney, who will file the necessary paperwork with the Family Court to request the child's last name be changed. Please be aware that the child's father will need to be served with a copy of the paperwork, and he can attempt to keep the name from being changed. Also, a Guardian ad Litem must be appointed for the child in this action, and that person can either recommend that the name be changed or not be changed.
These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
