In a nutshell, common law marriage is a situation in which a man and woman enter into a marriage without going through a formal marriage ceremony. South Carolina requires that the couple (a) consider themselves to be husband and wife, and (b) hold themselves out to other people as being husband and wife. Under those circumstances, the Family Court can find that they are married.
