What exactly constitutes forgiveness for adultery? Is it sex with your spouse? Is it spending the night together?

To use reconciliation as a defense to adultery, you must prove that you resumed cohabitation and intended to resume your husband/wife relationship. An argument can be made that a sexual encounter and/or spending the night together would be enough, but it's not guaranteed.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
