Legal Question in Family Law in South Carolina
Can you get a copy of text messages to use to find out if someone is cheating?
1 Answer from Attorneys
Once an action has been filed in Family Court, it's possible to issue a Subpoena to the cellular phone provider to get records, but all they are usually able to provide is the date/time that text messages were sent and to whom they were sent. They typically do not maintain the content of the messages themselves.
These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
