Legal Question in Family Law in South Carolina

My ex and I went before a court on Greenville SC in 2004 for an annulment. The judge ordered a continence on the grounds he give our son back to me, or file for divorce. It was my ex's responsibility to have the papers drawn up and have them signed and filed. He never did that. Instead, he remarried, and ignored me totally for 8 years.

Suddenly, he calls me 2 months ago, and tells me our son is coming home to me, which he is now. So..does this mean I can finally get my annulment, or something? We've been living separately since 2001. My son is here now, and I want to finalize the mess, and I quote from most attorneys I spoke with, " it's our mess, we can clean it up".

I went to court thinking it was a court date to decide the grounds and when to appear for our case. It wasn't. I did not know that. Anyway. We ended up not having attorneys with us at the time. What should I do? Please help me ??
