Legal Question in Family Law in South Carolina

Court Order

I was awarded $5000.00 in attorney fees against my son's father. A judge put it in her final court order. This was two years ago and I have not received the money. Do I need to retain an attorney to go to court and persue getting the attorney fees owed?

Re: Court Order

You need to file a Rule to Show Cause (contempt) action against him to seek to enforce the Order and have him held in contempt for not complying with its terms.

You "can" file this yourself, but you will be much better off having an attorney do this for you. Further, the Court will generally award additional attorney's fees for the contempt action as well.

If you need more information, you can visit my family law blog (www.SCFamilyLaw.com) or our website (www.StevensFirm.com). I wish you the best of luck.
