Custody

If there is no restriction on a parent to take a child out of state, the husband is under a restraining order, can he get the wife for kidnapping if she wants to get away from the abuse?

A parent will not be "kidnapping" his/her child unless he/she takes the child in violation of a Court Order or a statute.
