Legal Question in Family Law in South Carolina

Debt after Divorce

My divorce was finalized Jan. 2007. In the decree it states that all debts are settled and each party is responsible for any debt in his/her name. My ex-husband has just notified me that he is attempting to buy a house. He states that there are items on his credit report from debt incurred during our marriage. I too have had to take care of debt incurred during the marriage. He says unless I pay 1/2 of the debt, he will take me to court. Am I responsible for his debt after the divorce decree was finalized? Can he withhold my child support which he is threatening to do if I don't pay him? These debts do not appear on my most recent credit report from 2 weeks ago.

Re: Debt after Divorce

The answer to this question is dependent upon the specific facts of your case -- specifically the language included in the Divorce Decree and the details of the debts in question.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
