Legal Question in Family Law in South Carolina

desires to relieve my divorce attorney

my attorney that I retained was communicating with my husband so I was asking the courts to relieve my divorce attorney. I am now being told that I have to have my husband that I am divorcing signature on the consent order relieving counsel. I retained this attorney why to I need my ex-to-being signature?

Re: desires to relieve my divorce attorney

The Court requires that Consent Orders be signed by all parties to an action. Your husband cannot really take a position for or against your releasing your attorney, as it doesn't affect him.

Another option is to release your attorney, retain another attorney, and then have an Order Substituting Counsel issued. That will kill two birds with one stone effectively and also enable your new attorney to get up to speed quicker.
