Legal Question in Family Law in South Carolina

Divorce and the dog

My brother in law and his wife are separated (not legally) and contemplating divorce. She left two months ago with her son and one of the dogs. She left the other dog and has not come back for her or asked about her well being. This past week, my brother in law asked me if I wanted the dog and I said yes. She found out and went on a rampage. Said she was going to have him arrested for giving away the family dog. Told him it was against the law to give away anything. Does my sister in law have the right to get the dog back or am I legal in keeping her since my brother in law gave her to me?

Re: Divorce and the dog

From the information you provided, it doesn't sound as though anyone is "breaking the law." Unless a restraining order has been issued prohibiting him from disposing of any marital assets, he can sell or transfer them to another person. However, the Court can require him to account for the value of the asset later, in some cases.
