Legal Question in Family Law in South Carolina
Divorce
My husband and i have decided to divorce due to the fact that he is having problems with medications that were given to him almost 2 years ago when he was hurt at work. This has been an ongoing problem and i have tried to get him the help that he needs but he resists. He is currently at his parents and has been there for almost a week. We want this to be as simple and easy on our son as possible. We have discussed everything and have agreed. We would like to use the same attorney. I need advice on an attorney in my area willing to work with me with limited funds. I have been the only one in the household working in two years. Help please.

Re: Divorce
In South Carolina, it is not possible (or ethical) for an attorney to represent both sides in any Family Court matter. Your husband does not have to hire an attorney if he does not wish to do so.
If you believe that you have an agreement on all issues, then you should consult with an attorney to discuss having him/her prepare a proposed agreement for your husband to review. That course of action is typically the easiest, least expensive, and least stressful way to resolve situations such as the one you describe.
These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
