My husband drinks all the time, what are my rights for divorce?

In South Carolina, a divorce may be granted on one or more of the following five grounds:

1. Adultery;

2. Desertion for a period of one year;

3. Physical cruelty (abuse);

4. Habitual drunkenness (which can include either alcohol and/or drugs); or

5. Living separate and apart without cohabitation for a period of one year.

If you can prove that your husband regularly consumes alcohol to the point of intoxication, you can obtain a divorce on habitual drunkenness.

It is important that your case be handled correctly, and you should therefore consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
