Legal Question in Family Law in South Carolina
Divorce
My husband and I are going to be getting a divorce. We purchased a home together while we were married. He put the home in his mothers name. Our homeowners insurance and everything goes through her. I have two small children and am the only one working. Can my husband take my home from me? Also he is on workman's comp. Will I have to pay him alimony? Please help!!

Re: Divorce
If the home is titled solely in his mother's name, then things are very tricky. You will need to name her as a party to your divorce case, and the Court will have to determine what happens to the home and the equity in it.
As for your alimony exposure, it is not possible to answer that question without knowing much more information. In general, it is rare for men to get alimony from their wives in SC, but it is not unheard of when the wife makes much much more than the husband.
These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
