Legal Question in Family Law in South Carolina

Divorce and Inheritance

My husband is about to inherit a goodly sum of money from the sale of property his family has inherited. Should we divorce, am I entitled to claim any portion of that inheritance? We are also discussing divorce and I would like to know this before anything actually occurs.

Re: Divorce and Inheritance

The answer to this question can change based on the specific facts of your particular situation. However, the answer is typically that inheritances to an individual spouse are not marital property.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
