Legal Question in Family Law in South Carolina

Divorce

In SC if you have been seperated for over a year but then co habitatid again for financial reasons and for the children, can you still get a divorce for reason of being seperated for over 1 year?

Re: Divorce

No, you cannot. The one year must be continuous and up until (and through) the time the action is filed. By resuming cohabitation, you reset the clock and must again separate for a year before filing.

If you need more information, you can visit my family law blog (www.SCFamilyLaw.com) or our website (www.StevensFirm.com). I wish you the best of luck.
