Legal Question in Family Law in South Carolina

divorce

I have been seperated from my husband for nearly 3 years but have not filed for divorce for several differant reasons, however I have recently tried to contact him to settle this and his family has informed me that he has been missing since sometime last year. My question to you is, how long does a person need to be missing before no divorce is needed. I live in the state of South Carolina

In South Carolina, the fact that the other party is "missing" does not remove the necessity of obtaining a divorce. If you do not file for a divorce, you will remain married until one of you dies.

If he cannot be found, he can be served by publication in a newspaper. Therefore, you can proceed with the divorce even if you cannot locate him.
