Legal Question in Family Law in South Carolina

divorce settlement

I was awarded attorney fees & net profits from sale of home. Ex was ordered to pay mortgages & repay my lawyer. Ex has not repaid my lawyer in addition he is behind on mortgage payments & threatening to ''dispose'' of the home. Order states that I am not responsible for this debt, but what happens if ex files for bankruptcy or defaults on the home loan? Should I file contempt charges or wait? What will work towards securing my settlement & keepng my home until it is sold? How do I protect my settlement?

Re: divorce settlement

You have several options available, but your best option is probably to file a contempt action to enforce the terms of the prior Order.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
