Legal Question in Family Law in South Carolina

Divorce

If my wife loses job because of a layoff before the divorce is final, what income will be calculated in final child support agreement. We made all of our agreements for divorce before she was laid off. Will they look at her highest income of the job she had when we separated and agreed upon?

Re: Divorce

If you have an agreement, then her employment situation may not be an issue. If it does become an issue, the Court can impute income to her based on her earning capacity, even if she has no income at present.

If you need more information, you can visit my family law blog (www.SCFamilyLaw.com) or our website (www.StevensFirm.com). I wish you the best of luck.
