Legal Question in Family Law in South Carolina

Driver Insurance for minor - divorce case

The mother of my step son is saying that we have to pay for his car insurance. She is taking us back to court. We have joint custody, 50/50 with time, except we also get vacation days and she doesn't so we actually get him more. We pay $310 per month child support share all other expenses 50/50. According to DSS child suppport guidelines, we shouldn't even be paying child support becuase of the 50/50 time and splitting all other cost, please we pay health insurance. Is she correct in saying we should also have to pay his insurance when he gets his license (this month).

Re: Driver Insurance for minor - divorce case

Unless the support order specifically requires you to pay the car insurance, then you are probably not "required" to pay it. However, you mention having to "share all other expenses 50/50", which might trip you up.

Without looking at your specific order, it is impossible to answer your question with any certainty. You should consult an experienced family law attorney to find out what your options are based on the facts of your particular case.
