Legal Question in Family Law in South Carolina

enforcement of a subpoena

i have an employee who is going through family court for support modification. his ex-wife pays him, and she is trying to have it reduced. she has subpoena'd all records associated with company, as well as several companies that i do business with. this employee has no ownership in company, and is paid bi-weekly. it is not commission based. he recieves a w-2 at the end of the year. should she be able to access ALL records, or just his w-2's from years requested?

Re: enforcement of a subpoena

Typically, she would be entitled to the information related to him, such as his pay information, his employment file, etc. I don't think that she would be able to get all of your company's information that is not related to him in any way. You may want to consider filing a Motion to Quash her subpoena and/or for a protective Order.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
