my ex-husband and i have joint custody. does his current wife count as a legal guardian to our two young children?

Your ex-husband's current wife does not count as a legal guardian for your son unless there is a Court Order stating that she is a guardian. As joint custodian, however, your ex-husband can allow his current wife to participate in school activities, take the children to school and pick them up, attend doctors' visits, and participate in other ways in their lives. If this is creating friction, you may want to consider mediation as a way to address these issues. If she is abusing the children or interfering with your custodial rights or visitation, you may want to consult an attorney about having your custody modified by court order.
