Legal Question in Family Law in South Carolina

Failure to comply with divorce decree

I was divorced several years ago, in the decree it states he was responsible for financial obligations on mobile home. He stopped making payments, after losing his job. It was repossessed, showing as charge off on credit report. Creditor says he has to pay full amount owed to show paid in full and can not be removed from my credit report. The divorce decree says he has to pay for my defense in the case of repossession. Do I have a case to hopefully repair this blemish on my credit record? If so how do I begin the process and how much red tape is involved?

Re: Failure to comply with divorce decree

You have several options, based on the facts you alleged. You can probably pursue a contempt action against him for (a) failing to make the payments and also for (b) failing to make them in a timely manner. The Court has several options once they find him in contempt, which can include fines, jail time, etc.
