Legal Question in Family Law in South Carolina

false allegations of sexual abuse

My husband was accused by my sister of sexually abusing our children. These allegations were unfounded by the court. What are the consequences of making such false allegations? Our lawyers were court appionted and they did not really tell us what we could do to her for making such false allegations.

Re: false allegations of sexual abuse

If your husband believes that your sister has defamed him by making false, slanderous allegations, he can sue her in civil court for money damages. Of course, all of the allegations will have to be rehashed, which will probably be unpleasant for everyone, but your husband may decide that it's worth it anyway. Also, since the only relief that can be obtained in this type of case is money, he will want to make sure that your sister has enough assets to pay any judgment that he may receive against her, otherwise the case will be an exercise in futility. Good luck.
