Legal Question in Family Law in South Carolina

family

I plan to move out of state and my oldest child wants to finish school year and sports season before coming. His father doesnt have legal parental rights but does involve himself regularly with him. The child would remain with him for this short period. Can he try to gain custody being that I am allowing this to happen?

Re: family

If you leave the child with the father and you leave the state, the father can try to modify custody. Whether he will do that and his chances of succeeding if he does are different questions. There are steps that you can take to protect your interests and minimize those chances.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
