Legal Question in Family Law in South Carolina

father not listed

My question is this. My husband and I are from South Carolina and reside here still. We have been married for almost 2 years. Our son is almost 6 years old. My husband was not listed on the birth certificate because we were broken up at the time, and had our fair share of problems. He did his share to take care of our son and support him like any good man would. It just took us four years to get back together and end up married. How can we get his name on the birthcertificate.

If no one is listed on the birth certificate, then you should check with DHEC and there should be some forms that could be completed to accomplish what you ask.

If someone else is named as the father, then you will need to bring an action in Family Court to have that person declared not to be the father and your husband declared to be the father.
