Can father keep son from mother?
I have a 4 year old son who has been living with his father due to the fact that I could not support him. The father & I were never married & have not been to court to determine custody. Now that I am in a position where I can take care of my son the father refuses to let me have him for more than a few hours & even went so far as to tell me that I can't even call to check on my son. He says I can not bring him to my house to spend the night because I live out of state (North Carolina). Can he do this? What could/would happen if I brought my son home with me against the fathers wishes?

If you have never been to Court over this child, then both parents have equal rights to the child. He cannot impose conditions on you, unless you agree to let him do so, and vice versa. If you are not satisfied with the current situation, you should bring an action in Family Court to have the issues resolved.
