Legal Question in Family Law in South Carolina
Father's rights
I am friends with a man who would like to end his very unhappy marriage, but is not willing to give up daily time with his two year old son. He is very involved and the mother is bipolar and spends alot of time sleeping due to medication. She is not really ''unfit'' as in abusive or anything. More like neglectful. She has also moved her friend into their home. This friend just left her husband and three children behind. She doesn't have the best character. Is there any way that he can have a chance for custody of his son?

Re: Father's rights
If he is an active father, then he will certainly stand a good chance of getting custody. His chances increase if the mother has "issues" on her side, such as the bipolar diagnosis.
These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
