Legal Question in Family Law in South Carolina

Father's WInning Custody?

I have a 1yr old son. His mother and I do not live together and were not married. She lives in SC; I live in GA.I take care of him (diapers, food, clothes, toys, insurance, etc...), but I go through a great ordeal just to be able to bring him with me and spend time with him. Whenever I make plans to be with him, she gives me a difficult time, and half of the time she says he cant go with me. We are no longer together, and the only way she allows me to see him is for me to come to SC and spend time with him. I have spent a lot of time with him by traveling to SC and staying there. However, I have spent less than 3 weeks total with him alone. She tries to control the situation. I feel that I can provide a better and more stable environment for him. She is emotionally unstable and is seeking counseling. Se has other children who she spends little to no time with. She is verbally abusive towards them and uses fowl language way too often. One of her children recently went to live with his father because she did not have the time or patience to deal with him. She also uses my child as a pawn to get what she wants from me. She spends little time with him. Her mother baby-sits in everyday in an environment that is not the best for him.

Re: Father's WInning Custody?

You should consider bringing an action in Family Court to have the Court force her to allow you reasonable visitation. You might have a possibility of getting custody as well due to her actions, if you wish to go that route.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
