Legal Question in Family Law in South Carolina

My fianc� moved into my home almost 9 years ago. We never got married and we have one child together. I have since learned that he is an alcoholic. He has deteriorated over the years and is now mentally, emotionally, and verbally abusive to me and my children. I have asked him to leave and he refuses. Can I file an eviction notice? Or do other actions need to be taken? We have presented ourselves as husband and wife, but everything is in my name, including the house.

If you have presented yourself as husband and wife, then you may be common law married, which needs to be addressed first. If you do have a common law marriage, then you will need to go through a separation or divorce. If you are not, then the Family Court will need to address the issues pertaining to your child.
