Legal Question in Family Law in South Carolina

fighting for custody

My ex husband was fighting me for custody of our son who was 7 at the time. My lawyer told me since i had lost my job, i didn't have a foot to stand on. I told her he had drug charges on him and a record at dss for domestic violience on my other son who was 5 when that happen. She told that didn't matter. With her telling me that I agreed for him having custody knowing that it wasnt the best for my child. Did I get screwed? And will it be hard for me to custody back?

Re: fighting for custody

In SC, there are many, many factors that go into making custody decisions. The ones that you mention are certainly important (on both sides), but there are other factors that were not mentioned that could make a significant impact on the Court's decision.

Typically, you can seek a change in custody once there has been a significant or substantial change of circumstances. However, these laws can vary from state to state, so it is important to talk with an attorney in the state where jurisdiction lies in this case.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
