Legal Question in Family Law in South Carolina
grandchildren custody
my step daughter has 2 children 5 & 10, she has type I diabetes and continues to drink alcohol and do drugs, she also has begun leaving the children with her dad and I saying she will come back in a few hours and then doesn't show up until the next day and can't understand why this behavior is not ok. She has also done this to her mother several times. These times are all documented by us and her mother. The childrens father is deceased and we feel that the children are in danger of neglect and/or emotional scarring from their mother's behavior. The kids are really great and we would love to provide a stable environment for them, is there any way to get custody taken away from their mother due to her self abusing behavior? Even if it is temporary. any information would be helpful

Re: grandchildren custody
It is possible for a non-parent to take custody of children from a biological parent, but it is very difficult to do so and the standard of proof is high. These situations are very fact specific, and it is impossible to address all the possible scenarios in this forum.
These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
