Legal Question in Family Law in South Carolina

Grandparent concerns

My husband & I found out through a paternity test Feb 2007 that we have a 10 year old grandson, neither biological parent (our son & the child's mother) have custody, the maternal Uncle & his wife have joint custody. We've met and have had a great relationship until the Uncle & Aunt seperated. I just found out that he has been taken out of school and moved from the town he was living and has not contacted any of us. The Aunt claims she doesn't know where they are. Our concern is the child has been severly abused which is why the Mother lost custody. Do we have any recourse to make sure he is safe? The father pays child support but is on disabilty for mental illness so he can't parent the child either.

Any advise would be greatly appreciated-

May God Bless you for the work you do-

Re: Grandparent concerns

Generally, grandparents have minimal rights to demand visitation with a child against a parent's wishes. However, in this case, since neither biological has custody, you do have some options toward that goal.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
