Legal Question in Family Law in South Carolina
House bought by spouse
Before separation my wife decided she wanted out of our marriage (in S. C.) She went out and bought a house on her own in her name. The house we lived in while together was in my name. She is suing me for the sale of marital residence (which is solely in my name) and half equity. Is there any way I can recoup or cancel out her suit since she basically ''deserted'' me and bought this other residence (solely in her name)?

Re: House bought by spouse
The Family Court will equitably divide the marital assets (and debts) accumulated during the marriage. In the example you gave, the equity in both houses will be included in that distribution.
These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
