Legal Question in Family Law in South Carolina

Want husband out of house

I have a husband who I am wanting out of the house due to his drug problem. The police have told me they can't do it. My house is paid off and is in my name. I was paying the mortage on my home before I met my husband. It was never remorgaged and I made all the payments. He has helped only by giving me the money. Again the deed is in my name.

Can I legally change the locks and put his stuff out to get him out of the house? I'm honestly in fear of my life and he is not mentally stable.

Re: Want husband out of house

You can try to lock him out of the house, and he can break back in if he chooses to do so. The police should not arrest him for breaking into his own home (even though it's titled in your name). These types of situations can be dangerous, so it is important that you pursue it in the correct manner -- that being through Family Court.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
