if the husband leaves the home and they have young children, can he be charged with child abandonment by her lawyer?

If the parties do not wish to be married any more, then someone HAS to leave the home. The Court will not hold it against the person that leaves, assuming that he/she leaves in a responsible, reasonable manner. If that is the case, then abandonment is not a concern, but there are better and worse ways of leaving.
