Legal Question in Family Law in South Carolina

My husband moved out of our home on March 27, 2009 and has maintained separate residence since that time. We did spend one night together since that day. Does this disqualify us from the one year separation needed for an uncontested divorce in South Carolina?.

Spending the night together (in and of itself) does not necessarily restart the clock on the "one year separation" requirement.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
