Legal Question in Family Law in South Carolina

My ex husband is in prison and I refuse to allow our children to visit him there. Our divorce was done while he was incarcerated, so I was granted sole custody of the children. He is now threatening to try and force me to allow the kids to visit in prison. I live in SC, can he do that?

If he believes that you are violating the terms of the Order, his remedy would be to file a contempt action against you. I believe that it is very unlikely that a Judge would require you to take the children to prison to visit him.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
