Legal Question in Family Law in South Carolina
Is my husband recieving his Social Security Benefits?
In our custody case of our child, the judge ordered me to pay joint custody child support while my ex husband was awaiting his SS benefits to begin. The Judge also ordered him to notify the court if he had any financial changes or when the SS benefits started so that they could recalculate the child support. While picking up my daughter, he slipped and mentioned something about getting it started and showed me a large amount of money that he had in his wallet. How can I find out if he is recieving his benefits? will I have to get a lawyer to get the records of his SS account? or is there a way?

Re: Is my husband recieving his Social Security Benefits?
You basically have two options: (a) ask him if he is receiving them, or (b) bring a contempt action to seek to have you held in contempt of court for not notifying you.
Of course, if you choose option (a), he could lie to you, and it would be difficult to know if he is. If you choose option (b) and he isn't, then you would have wasted your effort. However, your attorney can issue a subpoena to get his records to verify it.
These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
