Legal Question in Family Law in South Carolina

ex husband rights

the principle of my children's new school, after receiving a copy of my full custody orders, informed me that she would not stop my ex from taking my children from school. He tried this at the old school and this is why I moved them. what can I do to protect them until the case against him is completed, his name isn't on any of their contacts for the school and I am afraid he will try to steal them again. He has a bench warrant issuesd for him (4mths ago) but nthing is happening. please help...

Re: ex husband rights

If he is violating the terms of an Order, you should pursue contempt charges against him. If there is a bench warrant issued for him, you should notify law enforcement as to his whereabouts so that they can pick him up. You should also let the principal know about the bench warrant.

If the Order does not prohibit him picking the children up from school, you may want to consider going back to Court to have another, more specific Order issued. The school can't read things into the current order, so you need to make sure that the orders are as clear as possible.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
