Legal Question in Family Law in South Carolina

My husband of 6 years and I want to file for divorce. He is active duty army and stationed in GA. We lived together in AL from 1/09 to 10/09. I moved to SC on 10/6/09 with our three children. I kept my legal residency in SC. I'm trying to determine I have to file.

More information would be needed, but it sounds as though SC will have jurisdiction to grant you a divorce because you have kept your legal residency here for more than one year. You don't mention where your husband's residency has been, but he can certainly consent for SC to have jurisdiction to address the issues in your case if he wishes to have it over sooner and easier.
