Legal Question in Family Law in South Carolina

My husband and I have been together 7 years, but married 5 years. We have 2 daughters....we are still living together, but not happy. I am a homemaker, so he is the provider for the family. He is believed to be cheating, as he were in the past. He verbally abuse me and my kids...and he wants nothing to do with us. He told me if I put him on child support that I wouldn't get a penny from him. He reminds me everyday that I have nothing without him, he tells me to get out of his house almost everyday. I want to know what actions can be done to him, because I fear that he would up and leave me and my kids at any given time. His income is around $725 every other week. I'm sure that a judge would order him to pay child support, but will I be granted spousal support/alimony for being unemployed....being that I am caring for my kids while he works? If you have any helpful information, please message me. [email protected]

Without much more information, it's not possible to give you a definite answer. However, if you get custody of the children, he will be required to pay child support. There are many factors that come into play with regard to alimony, including his income, your income, how the assets/debts are divided, etc. The Court will most likely require you to either get a job or it will impute income to you, if you are able to work.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
