Hi, my name is Jasmine. I'm from Greenville, my son father became disabled waist down 3 months after my sons birth. I tried putting him on child support but the judge threw it out because he recieves I think a once a month check. I think he is entitled to pay something. He has gotten this lump sum because of the accident. I'm just wondering, in this situation, what exactly can I do, I mean what is my son entitled to in a situation like this? Do I need to hire an attorney?

When one parent received Social Security Disability payments, the child typically receives an additional payment as a result, which could include a lump sum for the "back pay" amount. In most cases, the Court will allow the child's portion of the disability payments to satisfy the non-custodial parent's child support obligation. If you are not receiving those amounts, you probably should be.
