Legal Question in Family Law in South Carolina

I have a judgement of decree and separate maintenance. We will soon be officially separated for 1 year. How soon will we be divorced???? Are we still married after the one year separation if we're just waiting on the court to grant the divorce? Can I finally bring my children around my girlfriend? I'm not supposed to while we're still married??

You will not be divorced until a new divorce action is filed, the pleadings properly is served, a hearing is held, and a Decree of Divorce is granted. In other words, the Court will not automatically do anything once the year passes, it is incumbent upon you to bring the action properly.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
