Legal Question in Family Law in South Carolina

Kidnapping???

My ex and I got a divorce. I lost my children and my ex received custody because I didn't find out about the final court hearing until 4 days later. Throughout the divorce I couldn't afford an attorney and I still can't after 2 years. I haven't been able to talk to or see my children in 2 years. My oldest daughter is NOT my ex's biological child and the courts know it. My daughter told my mother that she doesn't think I love her anymore because I don't call. My ex won't let me. I can't afford a lawyer, but the longer I wait the less chance I probably have of getting my children back. I'm going crazy without them. Since my oldest daughter is not his child, if I took her, would that be kidnapping? I know it's wrong for a parent to take a child from the other biological parent, but she is NOT his child. Would it still be considered illegal. I just can't grasp the concept of HOW it could be. I'm being robbed of the years with my children because of my financial status.

Re: Kidnapping???

If there is a custody order and you take the children away without permission of the custodial parent, you will be kidnapping.

You need a lawyer. If you cannot afford one call the SC Bar Association pro bono representation line. You may qualify for help through it. 803-799-4015.
